Terms of Service

1. Agreeing to these terms

These Terms of Service (“Terms”) are an agreement between you and Skyscape LLC, a Puerto Rico limited liability company doing business as FarSeason (“FarSeason,” “we,” “us”), based in San Juan, Puerto Rico. They cover your use of farseason.com and our emails and related services (the “Service”). By using the Service, you agree to these Terms. Our Privacy Policy explains how we handle personal information. If you don’t agree to these Terms, don’t use the Service.

Section 17 contains an arbitration agreement and class action waiver that affect how disputes are resolved. Please read it.

You agree to receive communications from us electronically, including by email and on the Service. Electronic agreements, notices and communications satisfy any legal requirement that they be in writing.

2. What FarSeason is, and isn’t

FarSeason helps families discover worldschooling hubs, family camps, language programs and other educational travel, and introduces families to programs.

We don’t own, operate, staff, supervise or control any program listed on FarSeason. We are not a travel agent, tour operator or school, and we are not a party to any agreement between you and a program. Programs are independent of FarSeason. They are not our employees, agents or partners. Each program is solely responsible for what it offers, including its staff, supervision, safety, licensing, insurance, pricing, bookings, cancellations and refunds.

A listing on FarSeason is not an endorsement, certification or guarantee of any program. We don’t investigate or run background checks on programs or their staff.

3. Your responsibility and travel risks

You are responsible for deciding whether a program is right and safe for your family. Before booking, do your own research, including into the program’s credentials, staff screening, safety and supervision practices, insurance and health requirements, and any visas or documents you need. Decisions about your children’s travel, participation and supervision are yours.

Travel and participation in programs, especially abroad and with children, involve inherent risks. These include illness, injury, accidents, crime, natural disasters, political instability and differing safety standards. You understand these risks and accept them for yourself and the children in your care. We recommend appropriate travel and medical insurance.

4. Listings and other information

Listings are based on public sources, information from programs and our own research. They may be incomplete, out of date or wrong. Dates, prices, availability and other details change. Always confirm details directly with the program. Some photos are stock images that show a destination, not the program itself.

We decide which programs to list, how listings are written, and how they’re ordered and displayed. We can add, change or remove any listing at any time.

Information on the Service, including content from automated or AI tools and reviews or other content from users and programs, is for general information only. It may be inaccurate. We don’t verify user or program content. Nothing on the Service is legal, immigration, visa, tax, medical, educational or other professional advice. Check with qualified professionals and official sources before acting on it.

5. How FarSeason makes money

FarSeason may earn money from programs and partners, for example through subscriptions, featured or promoted placements, referral fees and affiliate links. This may affect which programs and offers appear and in what order. We may also offer paid features, promotions, discounts and referral rewards. These may have their own terms, which apply alongside these Terms. We can change or end any of them at any time, unless their own terms say otherwise.

6. Your account

  • You must be at least 18 to use the Service.
  • Give us accurate information, and use an email address you control.
  • We sign you in with links sent to your email, so anyone with access to your inbox can access your account. You’re responsible for activity on your account.
  • Saving or contacting a program with your email address may create an account for that email.

7. Contacting programs

Messages sent through FarSeason’s contact forms come to us first. We pass them to the program or programs you choose, as described in our Privacy Policy. We may choose not to forward any message, at our discretion. We don’t control whether, when or how a program replies. Contact forms are for genuine inquiries only. Don’t use them to advertise, solicit, recruit or send bulk messages. We may contact you about your inquiries.

8. Acceptable use

You agree not to:

  • break any law or anyone else’s rights;
  • send false, misleading, harassing, hateful or unlawful content;
  • impersonate anyone or misrepresent who you are;
  • scrape, copy or harvest data from the Service, by automated means or otherwise, without our written permission;
  • interfere with the Service, get around its security or limits, or access accounts or systems that aren’t yours;
  • use the Service to build a competing product or database.

9. Content you provide

You keep ownership of content you submit to the Service, such as messages and reviews. You give FarSeason a worldwide, royalty-free, non-exclusive license to use, store, copy, adapt, display and share your content to operate, improve and promote the Service. For messages to programs, this includes passing them to the programs you choose. Content you choose to post publicly, such as a review, may be displayed publicly. You are responsible for your content, and you confirm you have the right to share it, including any information about other people. We may remove any content at our discretion. If you send us feedback or ideas, we may use them freely, without owing you anything.

10. Our content and copyright complaints

The Service, including its design, text, listings and the FarSeason name and logo, belongs to FarSeason or our licensors. You may use it only for your own personal, non-commercial purposes. Program names and trademarks belong to their owners.

If you believe content on the Service infringes your copyright, email hello@farseason.com. Include the work, where it appears on the Service, your contact details, and a statement that you believe in good faith the use isn’t authorized. We may remove content and close the accounts of repeat infringers.

11. Changes to the Service

We may change, suspend or discontinue any part of the Service, including features that are free today, at any time. We may suspend or close your account, or limit your access, at our discretion, including if we believe you have broken these Terms. You can stop using the Service at any time.

12. Third-party sites and services

The Service links to and relies on programs, websites and services we don’t control. We aren’t responsible for them, and your dealings with them are solely between you and them.

13. Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, title, accuracy and non-infringement, to the fullest extent the law allows. We don’t promise that the Service will be uninterrupted, secure or error-free, or that any listing or other content is accurate, complete or current.

14. Limitation of liability

To the fullest extent the law allows: (a) FarSeason is not liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data or goodwill; (b) FarSeason is not liable for the acts, omissions, services or conduct of any program or other third party, including any injury, illness, death, loss or damage connected with a program you find or contact through the Service; and (c) FarSeason’s total liability for all claims relating to the Service is limited to the greater of US$50 or the amount you paid FarSeason in the 12 months before the claim arose.

These limits apply whatever the legal theory (contract, tort including negligence, or otherwise), even if we were told the damage was possible. Some jurisdictions don’t allow certain warranties or liabilities to be excluded or limited. Where that’s the case, these limits apply to the fullest extent permitted.

15. Release

Your dealings with programs and other third parties are between you and them. To the fullest extent the law allows, you release FarSeason and its owners, employees and contractors from all claims, damages and losses of any kind, known or unknown, arising from or connected with any program or other third party, or any dispute you have with one. If you are a California resident, you waive California Civil Code section 1542, which says: “A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party.” You also waive any similar law elsewhere.

16. Indemnity

To the extent the law allows, you agree to defend, indemnify and hold harmless FarSeason and its owners, employees and contractors from any claims, losses, liabilities and expenses (including reasonable legal fees) arising from your use of the Service, your content, your dealings with any program, or your violation of these Terms or the law.

17. Arbitration agreement and class action waiver

Try us first. Before starting any formal proceeding, email hello@farseason.com with your name, contact details and a description of the dispute and what you want. We’ll try to resolve it informally. Neither side may start arbitration or a court case until 60 days after the notice is received.

Arbitration. If we can’t resolve it, you and FarSeason agree that any dispute relating to these Terms or the Service will be resolved by binding individual arbitration, not in court. The American Arbitration Association (“AAA”) will administer the arbitration under its Consumer Arbitration Rules, and its Mass Arbitration Supplementary Rules where they apply. The Federal Arbitration Act governs this section. Fees are paid as those rules provide. Unless we both agree otherwise, the arbitration will take place by video or on written submissions, or, if an in-person hearing is required, in the county where you live. The arbitrator decides all questions about the scope and enforceability of this arbitration agreement, except as stated under “Class action waiver” below. There is no judge or jury in arbitration, and court review is limited.

Exceptions. Either of us may bring an individual claim in small claims court if it qualifies. Either of us may also go to court for an injunction to stop infringement of intellectual property or misuse of the Service.

Class action waiver. You and FarSeason may bring claims against each other only individually, not as a plaintiff or class member in any class, collective or representative proceeding. The arbitrator may not combine claims or award relief to anyone other than the individual party. If this waiver is found unenforceable for a particular claim, that claim (and only that claim) must go to the court described in section 18, and not to arbitration.

Opting out. You can opt out of this arbitration agreement within 30 days of first accepting these Terms. Email hello@farseason.com from your account’s email address with your name and a statement that you opt out of arbitration. Opting out doesn’t affect any other part of these Terms.

Changes. If we change this section, the change won’t apply to any dispute we were notified of before the change took effect.

Where this section doesn’t apply. If you are a consumer in a country whose law doesn’t allow pre-dispute arbitration or class action waivers for consumers (such as the EU or UK), this section doesn’t apply to you.

18. Governing law, venue and time limit

These Terms are governed by the laws of the Commonwealth of Puerto Rico and applicable U.S. federal law, without regard to conflict-of-law rules. Any dispute not subject to arbitration will be resolved exclusively in the courts located in San Juan, Puerto Rico, including the United States District Court for the District of Puerto Rico, and you agree to their jurisdiction. To the extent the law allows, you and FarSeason each waive the right to a jury trial. Also to the extent the law allows, any claim must be brought within one year after it arises, or it is permanently barred. If you are a consumer whose local law gives you rights that can’t be waived, those rights still apply.

19. General

These Terms are the entire agreement between you and FarSeason about the Service. If any part is found unenforceable, the rest stays in effect. Our not enforcing a provision isn’t a waiver. You may not transfer these Terms. We may transfer them, including as part of a merger, acquisition or sale. We aren’t liable for delays or failures caused by events beyond our reasonable control. We may send you notices by email or by posting them on the Service. Send notices to us at hello@farseason.com. If we provide a translation, the English version controls. Sections 2–5, 9, 10 and 12–19 survive after you stop using the Service.

20. Changes to these Terms

We may update these Terms from time to time by posting the new version here and changing the date at the top. Changes apply from the time they’re posted, and not to disputes that arose before then. If you keep using the Service after a change, you accept the updated Terms.
